We provide a convenient and environmentally friendly option to recycle your device. . This page provides you with information about us and sets out the legal terms and conditions (“Terms”) that apply to the sale of your device(s) to us.
Please read our Terms carefully before sending us your device(s). You should understand that by submitting an order, you agree to be bound by these Terms as we amend them from time to time. Every time you wish to place an order please check these Terms to ensure you understand the terms which will apply at that time.
These Terms, and any contract between us, are only in the English language

Please note "Device" refers to the mobile phone that you wish to sell in accordance with these Terms.
(a) About Us

We operate the website www.applerecycle.com (the “Site”). We are West One Technology Ltd, a company registered in England and Wales under company number 03608228 and with our registered office 153 Brooker Road, Waltham Abbey, Essex, EN9 1JH ("West One" or “us”). Our VAT number is 719304442.

(b) About You

By submitting an order on our Site, you confirm that:

  1. You are at least 18 years old; or have the permission of your parent or guardian to send us your Device.
  2. You are resident in Great Britain or Northern Ireland and you are accessing the Site from within the UK.
  3. You own all rights, title and interests in any Device that you send to us or otherwise have the right to send the Device to us.
  4. You are legally capable of entering into a binding contract.
  5. You are not using our service for any commercial or business purposes.
  6. You have removed any SIM cards, memory cards and any other accessory from the Device. We accept no liability for and costs or consequences if the SIM card, memory cards and any other accessory not removed.
  7. You accept full responsibility for cancelling any airtime contract associated with the Device, and for any airtime costs incurred before or after you send us the Device.
  8. All user data has been removed from the Device, including, but not limited to, personal details, text messages, photos, videos, voice memos. We accept no liability for the security or loss of data that is not removed.
(c) Use of the Site and how we use your personal information

Your use of the Site is governed by our Terms of website use

We only use your personal information in accordance our Privacy Policy.

Please take the time to read these, as they include important terms which apply to you.

(d) The Contract and your right to withdraw an offer

When using the Site and when submitting an order to sell your Device, you will be agreeing to enter into a contract with West One.

Our order process allows you to check and amend any errors before submitting your order to us. Please take the time to read and check your order at each page of the order process.

The contract between you and us will be formed when you confirm that you accept the price offered on the Site by placing an order on the Site or when you accept any revised price we offer as further described in the ‘Pricing’ section below. Please note that if your Device fails to meet our verification criteria we reserve the right to cancel the contract on notice with immediate effect.

At any time before we receive your device, you may cancel the contract by not sending us your Device. However, we will begin performance of the contract once we receive your Device and accordingly you will not able to cancel the contract whether under Regulation 10 of the Consumer Protection (Distance Selling) Regulations 2000 or otherwise once we receive your Device.

Responsibility for your Device will pass to West One when we receive the Device, in accordance with these Terms, and ownership of the Device will pass to us when we have dispatched a payment to you.

When we receive devices we check them using GSMA, which is a database of all devices that have been reported as lost, stolen or involved in criminal activity. If the device you send in appears on this database, it will be quarantined and the authorities will be notified. Please read the section entitled ‘Lost or Stolen Devices’ below for further information.

You may not transfer, assign, charge or otherwise dispose of a contract, or any of your rights or obligations arising under it, without our prior written consent.

(e) Our right to vary these terms

We may revise these Terms from time to time. Every time you submit an order the Terms in force at that time will apply to the contract between you and us.

(f) Your Device

By submitting an order on the Site you confirm that the Device meets our device valuation criteria as either a “Working” or “Non-working” device as described below:

    “Working” devices must:
  • Turn on and off (all buttons working and none missing);
  • Include original battery which can charge;
  • Meet manufacturer’s original specifications;
  • Be fully functional (software, operating system, camera, speaker, microphone moving parts etc.);
  • Have working screen/LCD/touch screen (no cracks or missing pixels);
  • Not be PIN or password locked;
  • Not be water damaged; and
  • Not be fake or registered as lost, damaged or stolen.
    “Non-Working” devices must:
  • Include battery; and
  • Not be crushed, bent or missing significant parts.
  • Screen, case, button and water damage are ok
(g) Postage

We have various posting options which include a freepost service. Our freepost service is only applicable when posting up to 2 phones or Devices at a time.

We do not take any responsibility for loss or damage to any Device before we receive it. We strongly recommend that you take all possible steps to protect your Device with packaging to minimise the risk of damage. You acknowledge that the recycling bag supplied does not guarantee that the Device will be received in the same condition as when it was sent.

Please note, Royal Mail recently introduced new guidelines and may destroy any Devices posted to us which contain a lithium battery and are not correctly packaged. We regret that we cannot take responsibility for any incorrect packaging of your Device. To prevent this situation arising please ensure that:

  • The battery is the original battery supplied by the manufacturer with your Device, that it is undamaged and that it is inserted into the Device;
  • That the Device is switched off; and
  • That you have placed the Device inside a cardboard box or padded envelope (provided) before posting it.

You remain solely liable (and we do not accept responsibility) for non-delivery of or damage to Devises in transit from you to us. We therefore recommend that you send items via the Post Office via Special Delivery to provide increased peace of mind and the ability to track your items. When doing so please note the terms and limitations relating to Special Delivery compensation cover as specified by the Post Office which may be amended from time to time.

(h) Pricing

Prices quoted on our Site are subject to change at any time without notice. When you place an order on our Site, our offer price is based on the stated condition of your Device and is guaranteed for 14 days from the date the offer is communicated to you. If your Device is received more than 14 days after the order was placed and contract completed, we reserve the right to cancel the contract and make you a revised price offer based on the current price at that later date.

As far as possible we will offer you the full value of our offer price for your Device. However when we receive your Device, if its actual condition varies from the stated condition or if your Device differs to the Device registered on-line, we reserve the right to cancel the original contract, recalculate the true value of the Device based on its actual condition and propose an adjusted price by email.

If you choose to decline our revised offer, we will return the Device to you however you may be required to pay an administration fee and/or any reasonable delivery charges we incur returning the Device to you. Please note that if you do not respond to our revised offer communication within 5 days by responding to the revised offer email or by telephoning us on 0845 4 133 888, you will be deemed to have accepted the offer and your order will be processed for payment at the revised price .

We will have the final decision on all device values.

Please note that device chargers, memory cards and other accessories will not increase the value of your order however we will accept any such accessories delivered to us with your Device. In the event that the contract is cancelled and a handset is returned to you, we cannot guarantee that these accessory items will be returned also.

(i) Lost or Stolen Devices

We will check the IMEI of all mobile phones and GSM enabled devices received on the GSMA database of blacklisted devices to ensure no lost or stolen items are purchased.

If a mobile phone or device is found to have records that indicate it has been lost or stolen, we will notify the seller by email and quarantine the mobile phone or device for 28 days.

If you are informed that your mobile phone is registered lost or stolen, you will be required to contact your network provider, to prove that you are the rightful owner and have the lost or stolen records associated with it cleared within the 28 day quarantine period.

If during the quarantine period the mobile phone or device is cleared on the GSMA database, your sale will be processed and paid for as normal. However, if after the quarantine period has expired and the lost or stolen records have not been cleared, then we are required by law to dispose of the mobile phone or device and you will not receive any payment.

UK legislation states that we cannot under any circumstances return or pay for a mobile phone or device which is registered lost or stolen at any time unless the lost or stolen records associated with it are cleared.

If we at any time become aware of any issues, you will be required to co-operate with the authorities and we reserve the right to withhold or cancel the payment.

(j) Data

Please ensure you remove your SIM card, memory cards and any other accessories before sending us your Device as they may contain personal details. West One accepts no liability if SIM cards, memory cards or other accessories are sent. We are unable to return them and they will be securely destroyed.

Although West One aims to securely destroy all data contained on the Device, we highly recommended that you download or erase all data on your Device, including contacts, SMS and picture messages, videos, music and any other data that may be personal to you. West One and Apple accept no liability for the security or loss of data that you do not remove from the Device or from any media used in conjunction with the Device.

(k) Payment

When we receive your Device we will check if it meets the expected valuation criteria and complies with these Terms.

  1. If it does we will aim to send payment by your chosen method within 3 working days.
  2. If it doesn’t we will notify you promptly and issue a revised offer as further described in the ‘Pricing’ section above. If you accept this revised offer, we will aim to send payment by your chosen method within 3 working days of your acceptance.
  3. If you do not reply to your revised offer we will send payment by your chosen method within 8 working days of the revised offer date

Please note, payment can only be made to the name, address and details provided when you submitted the order and incorrect details may result in delay or non-payment.

If you reject a revised offer and we agree to return your Device to you, we will only return the Device to the address you have registered with us on the Site. We will make a second attempt to return your Device if you are unable to accept the return on the first attempt. You may be required to pay postage related charges in accordance with the ‘Pricing’ section above. However if we are unable to return the device on the second attempt we will process it as normal at the price that we valued it at.

(l) Limitation of Liability

To the fullest extent permitted by any applicable law West One shall not be liable to you or any third party for any indirect, consequential or incidental loss, nor any loss of profit, sales, data, information or software or opportunity.

We do not in any way exclude or limit our liability for:

  • death or personal injury caused by our negligence;
  • fraud or fraudulent misrepresentation; or
  • any matter which it would be illegal for us to exclude or to attempt to exclude our liability.

You may have other rights granted by law, and these Terms do not affect these.

(m) Events outside our control

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a contract that is caused by an “Event Outside Our Control” as defined below.

An Event Outside Our Control means any act or event beyond our reasonable control, including without limitation strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, or failure of public or private telecommunications networks or impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.

If an Event Outside Our Control takes place that affects the performance of our obligations under a contract:

we will contact you as soon as reasonably possible to notify you; and

our obligations under a contract will be suspended and the time for performance of our obligations will be extended for the duration of the Event Outside Our Control.

(n) Communications between us

If we have to contact you or give you notice in writing, we will do so by e-mail or by pre-paid post to the address you provide to us in your order.

(o) Disputes

If you have any complaint about the Site or the services we provide, you should contact our Go and Recycle customer services department at the above address and we will try and resolve it as soon as possible. However, if we have a dispute regarding your use of the Site or these Terms, the courts will use English law to determine that dispute. If you wish to take legal action against us, as we are a UK company you should do so in the English courts only.

(p) Copyright and legal notices

The Information presented on this Site and contained on this Server is protected by a compilation copyright in the United Kingdom and in other countries. In addition, certain included Information is copyrighted by others. Copying, storing in machine-readable form, downloading, selling, publishing or otherwise disseminating the Information is strictly prohibited without the prior written consent of West One Technology Ltd. The Information contained on this Site and on this Server is the property of West One Technology Ltd.

The Information contained at the Site on this Server is subject to change without prior notice in particular, West One reserves the right to make changes to any products or services described or referenced to in the Site on this Server at any time without prior notice. West One shall not be responsible for the direct or indirect consequences of the use of the Information contained on this Site on this Server.
